Governing Law: These terms are governed by Spanish and European legislation.

By downloading, installing, or using the Encore application, you expressly accept these terms of service and our Privacy Policy. If you do not agree, you must stop using the application immediately.

2. Service Description

Encore is an iOS mobile application that provides a digital service for:

• Recording and organizing music concert memories
• Creating a personal archive of musical experiences
• Generating personalized statistics about your music history
• Managing multimedia content related to concerts (stored locally)

Important: Encore does NOT store photos or videos on our servers. All multimedia content remains exclusively on your iOS device.

3. User Rights and Obligations

Your Rights:

• Use the application in accordance with these terms
• Retain ownership of all content you create
• Request information about the processing of your data
• Cancel your account at any time

Your Obligations:

• Use the application only for legal and personal purposes
• Not attempt to access other users' systems or data
• Not violate copyright when uploading content
• Provide truthful information in your profile

4. Intellectual Property and Content

Application Ownership: Encore Archives retains all intellectual property rights over the application, design, source code, and trademark.

Your Content: You retain all rights to the content you create. By using the application, you grant us a limited, non-exclusive, and revocable license to:

• Process and display your content within the application
• Make technical backups necessary for operation
• Generate anonymous usage statistics

5. Payments and Transactions

Payment Processing: All payments in Encore are processed exclusively through Apple App Store.

Financial Data Security:

• Encore Archives does NOT store, process, or have access to credit card information
• Encore Archives does NOT store banking data of any kind
• All payment information is handled exclusively by Apple
• Payment terms and refunds are governed by Apple App Store policies

Billing: Invoices and payment receipts will be provided by Apple App Store.

6. Consumer Rights (EU/Spain)

Under European and Spanish consumer protection legislation:

• Legal Warranty: The application must function as described
• Right of Withdrawal: For in-app purchases, consult Apple's policies
• Dispute Resolution: Access to European online dispute resolution platform
• Transparency: Clear information about operation and terms

7. Liability and Limitations

Encore Archives Liability:

• Provide the application in accordance with the service description
• Maintain the security of the data we process
• Comply with applicable data protection legislation
• Notify about material changes to the service

Limitations (within legal limits): To the maximum extent permitted by Spanish and European law, we shall not be liable for indirect, incidental, or consequential damages. This limitation does not affect the consumer's inalienable rights.

8. Suspension and Termination

Termination by you: You may stop using the application and delete your account at any time from the application settings.

Termination by us: We may suspend or terminate your access if:

• You materially violate these terms
• You use the application for illegal activities
• You compromise the security of other users

In case of termination, your data will be deleted in accordance with our Privacy Policy.

9. Modifications to Terms

We may modify these terms when necessary to:

• Comply with changes in applicable legislation
• Improve the clarity or security of the service
• Add new optional functionalities

Notification: We will notify you of material changes with at least 30 days advance notice through the application or by email.

10. Dispute Resolution

Governing Law: These terms are governed by Spanish law.

Jurisdiction: Spanish courts will have exclusive jurisdiction to resolve any dispute related to these terms.

11. Final Provisions

Severability: If any clause of these terms is declared invalid, the remainder will remain in force.

Language: In case of discrepancy between versions in different languages, the Spanish version will prevail.

Waiver: The failure to exercise any right does not constitute a waiver of that right.
